GENERAL

According to the Law on Radiation Protection of the Republic of Lithuania it is prohibited to produce, operate, market, store, assemble, maintain, repair, recycle, and transport sources of ionizing radiation and handle (carry out pre-treatment of radioactive waste (collect, sort, decontaminate), carry out treatment of radioactive waste, store) and transport radioactive waste and, without possession of sources of ionising radiation, engage in practices under ionising radiation at the facility of another licensee, without Authorization.

The Authorization shall not be required:

1) for the practices involving sources of ionising radiation within the exemption levels;
2) for transport and storage of generators of ionising radiation;
3) for transport of radioactive substances in exempted packages.

There are two types of Authorization:
 
  • Licenses for activities with the sources of ionising radiation;
  • Temporary Permits for activities with the sources of ionising radiation.

Licenses are issued to Applicators (legal and natural persons, enterprises without the status of a legal person etc.) for unlimited time without revalidation of the license.

Temporary Permits are issued to foreign entities from countries of EU members or members of economic area of EU, who apply to perform authorized service with sources of ionising radiation in Lithuania for limited time and have corresponding authorization in countries of registration.

TYPES OF LICENCES OR TEMPORARY PERMITS

According to the Law on Radiation Protection of the Republic of Lithuania Radiation Protection Centre (RPC) is authorised to issues such types of Licences or Temporary Permits:

1) Licence or Temporary Permit to manufacture, operate, store, maintain, repair, recycle sources of ionising radiation and/or handle (carry out pre-treatment of radioactive waste (collect, sort, decontaminate), carry out treatment of radioactive waste, store) radioactive waste;
2) Licence or Temporary Permit to assemble sources of ionising radiation;
3) Licence or Temporary Permit to market sources of ionising radiation;
4) Licence or Temporary Permit to ship radioactive materials and/or radioactive waste;
5) Licence or Temporary Permit to engage in the practice under ionising radiation at the facility of another person holding the licence.

LEGAL BASIS

The order of issuing, specifying the License to legal persons on practices with sources of ionizing radiation, suspending, renewing or canceling the validity of License; conditions of licensed activities and supervision of these conditions, the rights, duties and responsibilities of the Licensees is described in Law on Radiation Protection of the Republic of Lithuania.

The list of documents and information, which should be supplemented to the Application depending on corresponding type of License or Temporary Permit is presented in the Rules on licensing the practices with sources of ionizing radiation approved by the Decree No 653 of the Government of the Republic of Lithuania on 25 May 1999 (Edit by Decree No. 1347 of Government of the Republic of Lithuania on 16 of November 2011).

The forms of Applications to get the License or Temporary Permit were approved by the Order No. 82V of Director of the RPC On the Approval of the Description how to prepare documents to get the License or Temporary Permit to perform activities with the sources of ionizing radiation or documents to change the Annex to the License or Temporary Permit and approval of forms of documents (adopted on 28 November 2011).

STATE FEE

State fee for (from 2017-10-10):
 
Issuing of license to manufacture, operate, store, maintain, repair, recycle sources of ionising radiation and/or handle (carry out pre-treatment of radioactive waste (collect, sort, decontaminate), carry out treatment of radioactive waste, store) radioactive waste – 196 Eur.

Issuing of other types of  licenses – 80 Eur.

Issuing of Temporary Permit to manufacture, operate, store, maintain, repair, recycle sources of ionising radiation and/or handle (carry out pre-treatment of radioactive waste (collect, sort, decontaminate), carry out treatment of radioactive waste, store) radioactive waste – 119 Eur.

Issuing of other types of Temporary Permits – 80 Eur.

Correction of data in the license – 25 Eur.

Correction of data in the Temporary Permit – 25 Eur.

TERM OF VALIDITY

Licenses are issued for unlimited time period.

Term of validity of Temporary Permits will be approved by RPC individually during issuance procedure depending on length, regularity, frequency, and continuation of the practices in Lithuania.

EXAMINATION OF DOCUMENTS SUBMITTED FOR ISSUANCE OF A LICENCE OR A TEMPORARY PERMIT

RPC shall, within 30 calendar days from receipt of all duly completed documents required for issuance of a Licence or a Temporary Permit, adopt a decision to issue the Licence or Temporary Permit or a reasoned decision to refuse issuance thereof and shall, not later than within 5 business days, inform in writing the applicator.

If the applicator has submitted an incomplete set of documents required for the issuance of a Licence or a Temporary Permit and has failed within the time-limit approved by RPC to provide the missing documents, the RPC, not later than within 5 business days, notify in writing such applicator that the application for issuance of a Licence or a Temporary Permit is left unexamined.

Issuance of a Licence or a Temporary Permit shall be denied, if:
1) submitted documents do not meet the requirements;
2) it is established during the state supervision of radiation protection requirements that the submitted data are misleading, inaccurate, incomplete.

Undecleared decision regarding the issuance of a Licence or a Temporary Permit shall not be qualified as issuance of the Licence or the Temporary Permit.
